대형마트 새벽배송 금지 규제의 법제도적 구조와 정책 재설계 방향: 유통 경쟁, 소비자 후생, 노동권의 균형을 중심으로

본 연구는 2012년 도입되어 13년간 유지된 대형마트의 영업시간 외 온라인 주문·배송을 제한하는 '새벽배송 금지' 규제를 종합적으로 분석한다. 유통산업발전법 제12조의2에 근거한 이 규제는 전통시장 보호와 노동자 건강권 보장을 명분으로 도입되었으나, 이커머스 플랫폼의 급성장 속에서 대형마트를 역차별하고 쿠팡 등 플랫폼 기업에 반사이익을 제공하는 결과를 초래했다. 본 논문은 법적 근거와 형성 과정, 유통 구조 변화, 소비자 후생 영향, 소상공인 보호 효과, 야간노동 문제를 다각적으로 검토하고, 규제 형평성 회복, 강력한 노동·안전 규제, 소상공인 상생기금 연동, 지역·계층별 접근성 격차 완화, 데이터 기반 영향평가 등 종합적 정책 재설계 방향을 제시한다. 이를 통해 소비자, 노동자, 소상공인이 동반할 수 있는 공정하고 지속가능한 유통 환경 구축의 필요성을 강조한다.

This study comprehensively analyzes the 'dawn delivery restriction' regulation on large retailers' online ordering and delivery outside business hours, which has been maintained for 13 years since 2012. Based on Article 12-2 of the Distribution Industry Development Act, this regulation was introduced to protect traditional markets and guarantee workers' health rights, but has resulted in reverse discrimination against large retailers and windfall gains for platform companies like Coupang amid the explosive growth of e-commerce platforms. This paper examines the legal basis and formation process, changes in distribution structure, consumer welfare impacts, effectiveness of small business protection, and night labor issues from multiple perspectives, and proposes comprehensive policy redesign directions including regulatory equity recovery, strong labor and safety regulations, small business co-prosperity fund linkage, regional and class-based accessibility gap mitigation, and data-driven impact assessment. Through this, it emphasizes the necessity of establishing a fair and sustainable distribution environment where consumers, workers, and small businesses can thrive together.
