어린이집 아동학대 근절을 위한 생태학적 분석 및 보육교사 전문성 제고 방안: 사례 분석과 제도적 대안을 중심으로

본 연구는 어린이집 아동학대의 구조적 원인을 생태학적 체계 이론을 적용하여 분석하고, 실효성 있는 예방 방안을 제시하는 것을 목적으로 한다. 2024년 아동학대 통계와 인천 연수구, 구미, 의정부 어린이집 판례를 심층 분석하여 신체적, 정서적 학대의 양상과 법리적 판단 기준을 고찰하였다. 아동학대는 교사의 직무 스트레스와 소진, 조직의 구조적 열악함과 폐쇄적 문화, 사회적 처우 저하와 교권 침해가 복합적으로 작용한 결과임을 규명하였다. 교사의 개인적 자질(인성과 정서 조절), 전문적 자질(발달 지식과 훈육 기술), 윤리적 자질(윤리강령 내면화)의 함양과 더불어, 교사 대 아동 비율 개선, 처우 개선, 심리 지원 강화, 법제도 정비 등 다층적 제도 개선을 제언하였다. 특히 서울시 시범사업 데이터를 바탕으로 교사 대 아동 비율 축소가 안전사고 75.9% 감소와 교사 스트레스 완화로 이어짐을 실증적으로 입증하였다. 본 연구는 아동학대 예방을 '감시와 처벌'에서 '지원과 예방'으로 전환하는 선제적 패러다임 변화를 제시한다.

This study analyzes the structural causes of child abuse in childcare centers using ecological systems theory and proposes effective prevention strategies. Through in-depth analysis of 2024 child abuse statistics and landmark cases from Incheon, Gumi, and Uijeongbu childcare centers, it examines the manifestations of physical and emotional abuse and legal judgment criteria. The research identifies that child abuse results from the complex interaction of teachers' job stress and burnout, organizational structural deficiencies and closed cultures, and social treatment deterioration and teacher rights violations. The study proposes cultivating teachers' personal qualities (character and emotional regulation), professional qualities (developmental knowledge and discipline techniques), and ethical qualities (internalization of ethical codes), alongside multilayered institutional improvements including improved teacher-child ratios, enhanced treatment, psychological support, and legal reforms. Based on Seoul's pilot project data, it empirically demonstrates that reducing teacher-child ratios leads to 75.9% reduction in safety accidents and alleviates teacher stress. This research presents a paradigm shift in child abuse prevention from 'surveillance and punishment' to 'support and prevention.'
