아동 성폭력 범죄인에 대한 교정복지 서비스의 현황 분석 및 개선방안 연구

본 연구는 아동 성폭력 범죄인에 대한 교정복지 서비스의 현황을 분석하고 개선방안을 제시하는 것을 목적으로 한다. 2016년부터 2018년까지 13세 미만 아동 대상 성범죄는 17.9% 증가하여 사회적 문제로 대두되고 있다. 현행 한국의 교정복지 서비스는 집중처우센터, 성범죄자 치료프로그램, 전자발찌 제도 등으로 구성되어 있으나, 재범 위험성 판단 기준의 불확실성, 프로그램의 획일성, 사후예방적 치료제도의 미흡함 등의 문제점을 지닌다. 본 연구는 독일과 미국의 사례를 비교 분석하여 재범 위험성 평가 기준의 정교화, 개인별·유형별 맞춤형 치료프로그램의 확충, 치료감호제도의 개선, 인력 충원 및 전자발찌 제도의 개선을 제안한다. 궁극적으로 응보주의를 벗어나 범죄인의 사회복귀를 지원하는 클라이언트 중심의 교정복지 실현을 목표로 한다.

This study aims to analyze the current status of correctional welfare services for child sexual offenders and propose improvement measures. Child sexual crimes against children under 13 increased by 17.9% from 2016 to 2018, emerging as a social problem. Current Korean correctional welfare services consist of intensive treatment centers, sex offender treatment programs, and electronic monitoring systems, but face issues including uncertain recidivism risk assessment criteria, uniform programs, and inadequate post-preventive treatment systems. By comparing cases from Germany and the United States, this study proposes refining recidivism risk assessment criteria, expanding customized treatment programs by individual and type, improving the treatment custody system, and enhancing personnel and electronic monitoring systems. Ultimately, it aims to realize client-centered correctional welfare that supports offenders' social reintegration beyond retributivism.
