우리나라 사회보장법의 체계와 복지국가 실현을 위한 미래지향적 발전방안

본 연구는 대한민국의 사회보장법 체계를 종합적으로 분석하고 복지국가 실현을 위한 미래지향적 발전방안을 제시한다. 헌법 제34조의 인간다운 생활을 할 권리를 기반으로 사회보험, 공공부조, 사회서비스로 구성된 사회보장법의 개념과 체계를 살펴본다. 현행 제도의 기능과 한계를 분석하여 노동시장 중심 사회보험의 한계, 급여 수준의 충분성 부족, 복지 사각지대, 제도의 분절성, 지역 간 격차 등의 과제를 도출한다. 복지국가 실현을 위해 중앙정부와 지방자치단체, 민간부문의 역할을 정의하고 민·관 협력의 기본 방향을 제시한다. 마지막으로 사회보장수급권의 권리성 강화, 보편적·선별적 복지의 조화, 새로운 노동형태에 맞는 사회보험 개편, 소득보장과 사회서비스의 통합, 지역사회 통합돌봄, 사회서비스의 공공성 강화, 지역 간 복지 격차 완화, 디지털 복지행정과 정보인권의 조화, 예방적 복지와 사회적 투자 강화, 지속가능한 복지재정과 사회적 합의 등 10가지 미래지향적 발전방안을 제시한다.

This study comprehensively analyzes the system of social security law in the Republic of Korea and presents future-oriented development plans for realizing a welfare state. Based on Article 34 of the Constitution regarding the right to maintain a dignified life, it examines the concepts and systems of social security law composed of social insurance, public assistance, and social services. By analyzing the functions and limitations of the current system, it identifies challenges including the limitations of employment-centered social insurance, insufficient benefit levels, welfare blind spots, fragmentation of systems, and regional disparities. To realize a welfare state, it defines the roles of the central government, local governments, and the private sector, and presents basic directions for public-private cooperation. Finally, it proposes ten future-oriented development plans: strengthening the rights of social security beneficiaries, harmonizing universal and selective welfare, reforming social insurance to fit new employment types, integrating income security and social services, establishing community-integrated care, strengthening the publicness of social services, reducing regional welfare disparities, harmonizing digital welfare administration with information rights, strengthening preventive welfare and social investment, and forming sustainable welfare finance through social consensus.
